Drugs used to provide improvement of cognitive functioning have been shown to be effective in healthy individuals. It is sometimes assumed that the use of these drugs constitutes cheating in an academic context. We examine whether this assumption is ethically sound. Beyond providing the most up-to-date discussion of modafinil use in an academic context, this contribution includes an overview of the safety of modafinil use in greater depth than previous studies addressing the issue of cheating. Secondly, we emphasize two crucial, (...) but hitherto nearly overlooked, nuances to the issues: the potential for modafinil to decrease inequality and disadvantage in academic settings, and the fact that how modafinil is used dramatically impacts its effects on health, coercion, fairness, authenticity and effort. Hymenoplasty is a surgical procedure requested by women who are expected to remain virgins until marriage. In this article, I assess the ethical and legal challenges raised by this request, both for the individual physician and for the health care system. I argue that performing hymenoplasty is not always an unethical practice and that, under certain conditions, it should be provided by the health care system.

One of the most controversial aspects in uncontrolled donation of organs after circulatory death is the initiation of preservation measures before death. I argue that in so-called opting-out systems only under very stringent conditions we might presume consent to the instauration of those measures. Given its current legal framework, I claim that this is not the case of Spain, a well-known country in which consent is presumed—albeit only formally—and where uDCD is currently practiced.

The so-called uncontrolled donation after circulatory determination of death (uDCDD) have been implemented in several countries, including Spain and France, to increase the availability of organs for transplantation. These protocols allow obtaining kidneys, livers and lungs of patients who do not survive cardio-pulmonary resuscitation performed in out-of-hospital settings. Simultaneously with the development and recent proliferation of these protocols, some emergency teams have begun to employ unconventional methods of CPR, with still uncertain but promising results. The coexistence of these two possibilities (...) raises some questions: At what point should attempts to save a patient with circulatory arrest be abandoned so that this individual can begin to be considered as a potential organ donor? How to manage potential conflicts of loyalties that may arise within emergency and procurement teams? How should the information to the families of those patients and potential organ donors be managed? In this paper we defend that elective ventilation, even if conceived as the instrument to maximise the chances of organ recovery, is mainly the means to provide the patient who is dying with a dignified death in several ways, one of them being the possibility of becoming an organ donor. Because EV does not harm the patient and permits the medical team a better assessment of the patient's clinical trajectory and a better management of the dying process by the family, (...) EV does not violate the principle of non-beneficence nor the principle of autonomy if we restrict the initiation of EV to those cases in which it is not known what the previous wishes of the patient were as regards to his or her care at the end of life. Hymenoplasty is a minor surgical procedure requested by women who, for cultural or religious reasons, need to remain a virgin until marriage. In this article I assess whether the public healthcare system of a liberal state should provide it as part of a policy of multicultural accommodation. I conclude that, in order to remain loyal to certain ethical ideals linked to the rule of law, liberal states should give access to hymenoplasty only to women for whom premarital virginity is a (...) precondition for their flourishing within their community and who say they are victims of sexual assault. In this essay, we focus on the moral justification of a highly controversial measure to redress medical brain drain: the duty to stay. We argue that the moral justification for this duty lies primarily in the fact that medical students impose high risks on their fellow citizens while receiving their medical training, which in turn gives them a reciprocity-based reason to temporarily prioritize the medical needs of their fellow citizens.

Resumen: El artículo establece paralelos entre el Concilio Vaticano II (1962-1965) y la Conferencia General del Episcopado Latinoamericano (Medellín, 1968), bajo la perspectiva común de la historicidade del “mistério de la Iglesia”. Un paralelismo fundamental: la creación del CELAM (1955) anticipa en la práctica la doctrina de la colegialidad episcopal, promulgada por el Concilio ( Lumem Gentium 22). Bajo el foco de la colegialidade eclesial, toda la intensa actividad de preparación de la Conferencia de Medellín, así como su realización y (...) su documento final, se construye “a la luz del Concilio”. A basic parallel arises: the creation of CELAM (1955) anticipates the doctrine of episcopal collegiality, promulgated by the Council (Lumen Gentium 22). Under the focus of the ecclesial collegiate, all the intensive activity of preparation for the Conference of Medellin, its realization and its final document, were made through the Council inspiration. By comprehending the Church as inserted in history the major themes and commitments of the Latin American Church are formulated: the evangelical option for the poor, the new way of being church founded in ecclesial communities, the theological dimensions of the aspirations and demands for liberation later formulated in Liberation Theology. Seen with theological eyes, the Council and the Conference of Medellín were a sign of the times, a historical movement of the Church towards the Kingdom of God. This discussion also refers to the current time of the Church as a “time in exile”. The present time is characterized by its detachment from the demands of the Council and of Medellín. Este estudio pretende demostrar el origen metodológico común del concepto de soberanía popular de Rousseau y Carl Schmitt, entendido como aquella autoridad política cuya legitimidad descansa en un principio democrático verdaderamente sustantivo. En primer lugar, se intentará probar cómo ambas obras serían la expresión de una común reacción al formalismo de una dogmática liberal que identifica metodológicamente la legalidad formal con la legitimidad política. Así, Rousseau critica un enunciado de la ley natural procedente de Locke que legitima la desigualdad social (...) y política y justifica el gobierno burgués de los propietarios y Schmitt cuestiona un positivismo jurídico cuyo normativismo habría ocultado el auténtico valor sociológico del poder y la soberanía. En segundo lugar, una vez avanzada una crítica de las representaciones políticas que niegan el carácter sustantivo del pueblo soberano, se estudia el modo en que ambos formulan una propuesta metodológica alternativa. Determinar el estatuto del embrión humano no es una tarea fácil y menos cuando existen realidades y propuestas diversas en torno al mismo. Si bien tratar de describir qué es una persona, resulta ya complejo por las dimensiones sociales, biológicas, psicológicas y espirituales que se involucran; cuando a ello le agregamos el valor antropológico,legal, ontológico y biológico del desarrollo de la persona, se complica todavía más. No obstante, cuando entendemos que no es adecuado generar conflicto entre disciplinas, sino, por el (...) contrario, que nuestra labor es la de dialogar y comprender que todos estamos trabajando con una misma realidad, podemos entonces vincular al ser humano en todas sus dimensiones, ver su integralidad y rescatar el valor originario del ser humano desde su concepción hasta su muerte. En especial, en el presente ensayo nos enfocaremos a dicho análisis para establecer una propuesta de cómo entender el estatuto del embrión humano desde los ámbitos biológico, legal, antropológico y ontológico. To manage conflicts between temptation and commitment, people use self-control. The process model of self-control outlines different strategies for managing the onset and experience of temptation. However, little is known about the decision-making factors underlying strategy selection. Across three experiments (N = 317), we tested whether the moral valence of a commitment predicts how people advise attentional self-control strategies. In Experiments 1 and 2, people rated attentional focus strategies as significantly more effective for people tempted to break moral relative to (...) immoral commitments, even when controlling for perceived temptation and trait self-control. Experiment 3 showed that as people perceived commitments to have more positive moral valence, they judged attentional focus strategies to be significantly more effective relative to attentional distraction strategies. Moreover, this effect was partly mediated by perceived differences in motivation. These results indicate that moralization informs decision-making processes related to self-control strategy selection. (shrink)

Despite emerging study of business initiatives that attempt to support local peace and development, we still have significant knowledge gaps on their effectiveness and efficiency. This article builds theory on business engagements for peace through exploration of the Footprints for Peace (FOP) peacebuilding project by the Federación Nacional de Cafeteros de Colombia (FNC). FOP was a business-peace initiative that attempted to improve the lives of vulnerable populations in conflict-affected regions. Through 70 stakeholder interviews, we show how FOP operationalized local peace (...) and development in four conflict-affected departments of Colombia, and examine FNC’s motivations for and effectiveness of its peacebuilding activities. Our main finding is that FOP’s success supported several existing theories on business engagement in peace both in terms of peacebuilding by business and for local economic and societal development, providing evidence in support of development–business collaborations and local peacebuilding by business under certain targeted circumstances. We relate these findings to existing literature, highlighting where existing business-peace theory is supported, where FOP challenged assumptions, and where it illuminated new research gaps. These findings serve to take business-peace theory forward and improve our understandings of what can constitute success for business-peace initiatives in Colombia and possibly other conflict-affected regions. In this context, some aspects related to the positive impact that Humanae Vitae lends to the affective environment of sexuality, both in adulthood and in the early ages of youth, are discussed given the influence of LGTBI ideology. The anthropological view of sexuality provides an environment of respect (...) for the dignity of the person in terms of the deviations that may occur due to the influence of gender ideology. Finally, some international scientific articles are cited, which positively demonstrate the possibility of making science compatible with the unitive and procreative nature of Humanae Vitae in a globalized environment. En el presente trabajo, analizamos el cuento El Inmortal de Borges prestándole principal atención a las situaciones donde se entrelazan, o se tratan sin diferenciar demasiado, cuestiones vinculadas con la animalidad y la divinidad. Sostenemos que esta especie de confusión o falta de precisión al tratar cuestiones que se alejan tanto de la identidad personal y del Yo, como la inmortalidad, no es un elemento casual ni sin fundamento, sino que puede ser analizado filosóficamente adentrándonos la otredad animal. El Inmortal (...) nos manifiesta que la filosofía podría no haber sido lo suficientemente precisa al tratar la otredad, permitiendo que animalidad y divinidad, o más bien ciertas propiedades características de cada una, puedan amalgamarse dentro de los lindes de este concepto. Que el cuento de Borges haga convivir de forma tan característica la inacción con la inmortalidad hace de esta obra un objeto de reflexión obligatorio para todos los interesados en el concepto de otredad. Background: Nurses are the largest professional group in healthcare and those who make more decisions. In 2014, the Committee on Bioethics of the Council of Europe launched the “Guide on the decision-making process regarding medical treatment in end-of-life situations” (hereinafter, Guide), aiming at improving decision-making processes and empowering professionals in making end-of-life decisions. The Guide does not mention nurses explicitly. Objectives: To analyze the ethical principles most valued by nurses working in palliative care when making end-of-life decisions and investigate if (...) they are consistent with the framework and recommendations of the Guide; to identify what disputed/controversial issues are more frequent in these nurses’ current end-of-life care practices. Design: Qualitative secondary analysis. Participants/context: Three qualitative datasets including 32 interviews from previous studies with nurses working in palliative care in Portugal. Ethical consideration: Ethical approval was obtained from the Ethics Research Lab of the Instituto de Bioética (Ethics Research Lab of the Institute of Bioethics) (Ref.04.2015). Ethical procedures are thoroughly described. Findings: All participant nurses referred to autonomy as an ethical principle paramount in end-of-life decision-making. They were commonly involved in end-of-life decision-making. Palliative sedation and communication were the most mentioned disputed/controversial issues. Discussion: Autonomy was highly valued in end-of-life care and decision-making. Nurses expressed major concerns in assessing patients’ preferences, wishes, and promoting advance care planning. Nurses working in palliative care in Portugal were highly involved in end-of-life decision-making. These processes embraced a collective, inclusive approach. Palliative sedation was the most mentioned disputed issue, which is aligned with previous findings. Communication also emerged as a sensitive ethical issue; it is surprising, however, that only three nurses referred to it. Conclusion: While the Guide does not explicitly mention nurses in its content, this study shows that nurses working in palliative care in Portugal are involved in these processes. Further research is needed on nurses’ involvement and practices in end-of-life decision-making. (shrink)

The present work includes a discussion about the Kantian ideal of progress and its repercussions in the construction of a cosmopolitan education, by virtue of weighing its validity and the challenges it faces in contemporary times. The manuscript analyzes the Kantian postulates about progress to clarify the guidelines of a cosmopolitan education. The document is structured thanks to the bibliographic study and the consequent systematic review of an exploratory type and the help of the hermeneutical method. The approach to the (...) subject begins with the analysis of the enlightened ideals of a cosmopolitan, universal, humanizing education project aimed at fulfilling the ultimate purposes of reason, as the preferred path for human improvement and social progress. At the end of this work, the incompatibility between that ideal of Kantian cosmopolitan education, which promised freedom and self-control, and the current system that promotes an idea of ​​progress far from these principles is made evident. La humildad copernicana establece que el Universo es un lugar homogéneo en el que las leyes aplican indistintamente en cualquier lugar, es decir, no existe un centro o lugar privilegiado. En ese sentido el lugar que ocupa la Tierra en el Universo es como cualquier otro, nada especial y mucho menos relacionado al favor de un Dios omnipotente cuya creación favorita sea el ser humano. Siendo esto así, sería entonces factible pensar la existencia de muchos otros planetas que como la (...) Tierra alberguen vida y sustenten civilizaciones tan o más avanzadas como la nuestra. Sin embargo, ¿por qué aún no hemos contactado con otras civilizaciones? Esto último se conoce como la paradoja de Fermi. ¿Por qué si la Tierra es solo un punto más en el Universo parece que no hay otras Tierras y otros seres inteligentes con quienes contactar? Una posible solución que intentamos discutir en el presente texto es la Hipótesis de la Tierra Rara, según la cual, en efecto, el planeta Tierra es una cosa extraordinaria en el universo. Más allá de discutir la plausibilidad de esta hipótesis frente a otras, interesa puntualizar algunos corolarios que se siguen de la misma, y su implicación para el copernicanismo desde un punto de vista filosófico. Estos modelos principales, cuantificándose hasta cuatro, además de otros de menor entidad, muestran la evolución en la conceptualización y las características que propuso para la ciudad del siglo XX. Su aplicación a las diferentes ciudades, tanto interiores como litorales, evidencian tanto la diversidad de su urbanismo como la adaptabilidad de los mencionados modelos a casos reales. Mimetic theory (MT) can explain both the success and malaise caused by the market. Success is measured by the spread of desire, and malaise by the mimetic resentment caused by this spread of (...) desire.In 1979, Paul Dumouchel and Jean-Pierre Dupuy applied René Girard's mimetic theory for the first time to economics in their book L'Enfer des Choses.1 Both authors defended the need to advance toward the construction of a mimetic economic science placing at the center of the analysis the mimetic nature of the human being. They pointed out that the liberal conception of the individual as a being who makes decisions of maximum utility and autonomously is wrong. In short, the point was that the traditionally accepted homo economicus has been replaced with the homo mimeticus.2 In his contribution [End Page 275] to the book, "L'ambivalence de la rareté," Dumouchel establishes that scarcity emerges or is born as traditional bonds of solidarity are abandoned by members of a society that, until then, had ensured that everyone was assisted in case of need. In primitive human society, reciprocal bonds of solidarity prevailed. There was no scarcity, and this internal solidarity limited violence between the members of the group and expelled it to the outside. Scarcity was invented after the creation of the vicious cycle of individualism and the commercialization of social relations: a social institution established by the modern world after the solidarity mechanisms that protected the group against violence were abandoned.3 For both authors, the market arose as the institution that replaced the sacred, containing the violence, in both senses of the word "contain": On the one hand it held the violence within, and on the other it limited the violence.From its publication, L'Enfer des Choses was adopted as the founding treaty of the mimetic economy, even by Girard himself, who referred to it on several occasions when discussing economic issues.4 Both Dumouchel and Dupuy have gone into greater depth with their findings in other subsequent studies that have taken different courses. Dumouchel has clarified his concept of scarcity and has analyzed the relationship between envy and mimetic resentment through the study of Helmut Schoeck's famous envy theory.5 Meanwhile, Dupuy defends that many developments of modern economic science are merely the evolution of homo economicus to homo mimeticus because the autonomous subject is abandoned, giving rise to one that takes into account the behavior of others (game theory, adaptive expectations theory, speculation theory, etc.). Dupuy insists on the concept of the market as an institution that effectively delays the mimetic conflict. However, he adopts a pessimist position, as capitalism, due to its very evolution, has ended up surpassing its own limits (controlling politics), and as a result, it is increasingly more difficult for capitalism to carry out its function of containing violence.6Using the work of Dumouchel and Dupuy as a base, different authors have made contributions to economics from the perspective of MT. Several studies have been conducted on money, trade, and speculation, highlighting the theory of money of Michel Aglietta and André Orléan.7 Although there are differentiating nuances among the authors, they all assume that the money and market institutions are essentially violent and sacrificial. Other examples of this school of thought are Andrew Lascaris (1987), Erich Kitzmüller (1995), Anthony W. Bartlett (2002), John Daniels (2008), and Daniel M. Bell, Jr. (2012).8 Byrne Hobart and Tobias Huber have successfully applied MT to the study of financial bubbles in an economic history study, with promising results.9 And in the criticism of the market system in his book À Charge de Revanche, Mark R. We give a characterization of the degree of non-functionality which is compatible with the propositional structure of quantum theory, showing that having truth-functional connectives, together with some assumptions regarding the relation of logical consequence, commits us to the adequacy of the interpretation sets of these connectives. An advantage of our proof is that it is independent of (...) the number of truth values involved, generalizing previous works. We also show the failure of the adequacy of every Nmatrix that is a model of the non-distributive lattice of quantum propositions. En este trabajo discutimos las nociones de adecuación y veritativo-funcionalidad en la lógica cuántica, desde el punto de vista de una semántica no determinista. Damos una caracterización del grado de no-funcionalidad compatible con la estructura proposicional de la teoría cuántica, mostrando que tener conectivos veritativo-funcionales, junto con algunos presupuestos relativos a la relación de consecuencia lógica, nos compromete con la adecuación de los conjuntos de interpretación de estos conectivos. Un punto ventajoso de nuestra prueba es que se independiza de la cantidad de valores de verdad involucrados, generalizando trabajos previos. Probamos también que falla la adecuación de cualquier Nmatriz que sirva como modelo para el retículo no distributivo de proposiciones cuánticas. (shrink)

How should civil society deal with radical actors such as populists? Should democrats engage in an open dialogue or avoid confrontation? Should they listen to them, let them speak and try to expose them argumentatively, or should they deny them any kind of public platform? Rather than providing a normative answer to these questions, this article analyzes and systematizes responses that are already circulating in public discourse. In particular, we focus on reactions to the invitations of the AfD politicians Alice (...) Weidel and Marc Jongen to the Oxford Union (2018), the Zurich Theater Gessnerallee as well as the Hannah Arendt Center in New York (both 2017). We will show that the debates gave excessive weight to fundamental questions of democratic theory while marginalizing the specific context factors of the events. Because of this, the populists eventually gained the moral victory. (shrink)

El presente capítulo presenta un análisis teórico del tipo de amor que involucra la sexualidad, las altas expectativas que genera y la incertidumbre de que se cumplan. Para esclarecer el estudio se distingue entre sexualidad, impulso amoroso (“eros”) y amor propiamente dicho (“ágape”) y se echa mano de conceptos tomados de la filosofía personalista incluidos los de naturaleza, persona, racionalidad, relación y los varios tipos de amor. A final de cuentas se propone que sólo cuando se vuelve conyugal puede el (...) amor sexuado puede desarrollar su máximo potencial. (shrink)

In two occasions a Bibliography of Structuralism has been published in Erkenntnis (1989, 1994). Since then a lot of water has flowed under the bridge and the structuralist program has shown a continuous development. The aim of the present bibliography is to celebrate the 25th anniversary of the publication of An Architectonic for Science –structuralism’s main reference work– and of its recent translation into Spanish by updating the previous bibliographies with titles which have appeared since 1994 as well as before (...) that year but which are not included in them. As in the former deliveries, this bibliography only covers books and articles that are concerned directly with the structuralist approach in the philosophy of science. We would like to thank the many colleagues who have helped us in collecting all the information. Notwithstanding we apologize in advance for the possible entries that we missed to include in this third Bibliography of Structuralism. (shrink)

In this introduction, we argue for a basic idea. Community-based spaces for promoting forgiveness and memory-making bear the promise of promoting some of the cultural transformations needed for thick, structural reconciliation. As we show by discussing some recent examples taken from the Colombian context of the past decade, these spaces do not compete, but actually complement a pragmatic, thin institutional design for reconciliation. This idea, as we discuss here, serves as the common thread connecting the articles in this special issue. (...) Este artículo indaga sobre el fundamento subjetivo de la percepción del tiempo. El abordaje propuesto recorre la idea husserliana del tiempo como experiencia íntima y flujo permanente. En el camino se aventuran especulaciones sobre la tradición filosófica inclinada a establecer vínculos indisolubles entre la conciencia, el conocimiento del tiempo y la imaginación. El hilo conductor es la correlación existente en la experiencia humana del tiempo a partir de la sucesión mental de esa triada compuesta por el pasado, presente y futuro. (...) Si la identidad humana se compone de procesos de memoria y la anticipación del futuro, entonces cabría preguntarse hasta qué punto las impresiones subjetivas del flujo temporal son fundamento básico de la autopercepción, el yo y cualquier mirada introspectiva. También se incluyen consideraciones sobre los efectos de la temporalidad en la consciencia y la construcción del yo. (shrink)
